Welcome to Nano Banana 2 Pro. By accessing or using the service, you agree to these Terms of Service. If you do not agree, do not use the service.

Service Description

Nano Banana 2 Pro provides an online AI image workspace for text-to-image generation, image-to-image transformation, prompt optimization, reference-guided editing, search-assisted context, and related export or download features. Certain features may require an account, credits, a paid plan, or a supported payment method.

User Accounts and Registration

1. Account creation: Some features require an account. You must provide accurate and current information.
2. Security: You are responsible for safeguarding your account credentials and for activity under your account. Notify us promptly if you suspect unauthorized access.
3. Eligibility: You must be legally able to enter into these Terms under the laws of your jurisdiction.

Content and Intellectual Property Rights

1. Your content: You retain ownership of the prompts, uploads, reference images, and other content you submit, to the extent permitted by law. You grant us a limited license to host, process, store, reproduce, and transmit that content only as needed to operate the service.
2. Outputs: As between you and us, you may use outputs generated for your account, subject to applicable law, these Terms, and any third-party rights that may apply.
3. No model training on your content: We do not use your content to train models.
4. Our rights: The service, interface, branding, software, and related intellectual property are owned by us or our licensors. You may not copy, resell, sublicense, reverse engineer, or misuse the service except as allowed by law.

Credits, Plans, and Payments

1. Credit-based usage: Certain generations or edits consume credits. Usage may vary depending on the workflow, model, or selected settings.
2. Paid features: Some features require a paid plan, credit purchase, or active billing method.
3. Payment processing: Payments are processed by Stripe or other designated providers. By making a purchase, you authorize the applicable charge.
4. Pricing changes: We may update pricing, credit costs, plans, or included usage from time to time. Changes apply prospectively unless otherwise stated.
5. Refunds: Except where required by law, fees are non-refundable.

Prohibited Activities

• Illegal activity or violation of others’ rights.
• Uploading or generating content that is infringing, obscene, exploitative, or otherwise prohibited by law.
• Harassment, abuse, unsafe uses, or content involving harm to minors.
• Uploading content you do not have the right to use.
• Scraping, reverse engineering, distributing malware, automating abuse, spamming, or attempting to bypass technical limits or security controls.
• Misrepresenting outputs as non-AI-generated where disclosure is required by law, contract, or platform policy.

Privacy and Data Collection

Our collection and use of personal data are described in the Privacy Policy. By using Nano Banana 2 Pro, you acknowledge that prompts, uploads, reference images, search-assisted inputs, outputs, billing metadata, and service usage information may be processed as described there.

Availability and Product Changes

• We may modify, suspend, or discontinue any feature, workflow, model option, or part of the service at any time.
• We do not guarantee that any specific model, setting, output style, or feature will always remain available.
• AI outputs may vary over time due to model behavior, prompt differences, reference inputs, or system changes.

Termination

We may suspend or terminate access to Nano Banana 2 Pro for violations of these Terms, legal risk, suspected fraud, nonpayment, abuse, or security concerns. You may stop using the service at any time. Clauses that by nature should survive termination will survive, including those related to ownership, disclaimers, limits of liability, and indemnification.

Disclaimer of Warranties

The service is provided on an “as is” and “as available” basis. AI-generated outputs may be inaccurate, incomplete, inconsistent, offensive, or unsuitable for your intended use. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the service will not exceed the amount you paid us for the service during the three (3) months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold us harmless from claims, damages, losses, liabilities, and expenses arising from your content, your use of Nano Banana 2 Pro, or your violation of these Terms or applicable law.

Governing Law and Dispute Resolution

These Terms are governed by the laws applicable in the jurisdiction where we operate, without regard to conflict-of-law principles. Disputes will be resolved in the courts with proper jurisdiction there, unless applicable law requires otherwise.

Changes to These Terms

We may update these Terms from time to time. Changes become effective when posted unless stated otherwise. By continuing to use Nano Banana 2 Pro after the changes take effect, you agree to the revised Terms, to the extent permitted by law.
